How to stop dine-and-dash with pay-first ordering

Take the money before the kitchen cooks. When the ticket only prints after the guest pays, a walkout has nothing to walk out on. Cameras, a host at the door and card holds make dine-and-dash rarer or easier to chase, but only pay-first removes it. The same rule also ends unpaid phone orders that never get picked up.

The deterrent list matches what Toast and WebstaurantStore recommend in their own guides. Pay-first is the only one that removes the open check.

Step by step

How to set up pay-first ordering

Find every open check

List each way food leaves the kitchen before money arrives: dine-in tabs, phone pickups, catering, staff-entered orders. That is your exposure.

Make the kitchen ticket wait for payment

Configure your ordering so the ticket prints only after the payment clears. On a QR table order the guest pays on the phone, then the kitchen sees it.

Offer fast wallets

Turn on Apple Pay and Google Pay. Card typing is where guests give up.

Give declines a clear rescue

When a card fails, show plain words and a second way to pay. Check your processor's fraud rules, ZIP checks and velocity limits, because they can block good guests.

Handle the second round

Let guests add to the same table and pay for just the new items, so nobody runs a tab.

Train one rule

Nothing goes to the kitchen unpaid. Staff can still help a guest pay on their phone or at the counter, but the rule does not bend.

Where unpaid food hides

Dine-and-dash is not just the dining room

  • Phone orders marked "pay at pickup" that nobody collects. The food is cooked and binned.
  • Second rounds at the table added to a check that has already been paid.
  • Catering on account with no deposit.
  • Card declines at the end of the meal, when the guest is already standing up.

Each one has the same fix: the order is not sent to the kitchen until it is paid. Our AI phone host texts a pay link during the call and the ticket prints only once it is paid.

What we measured

Pay-first at our proof restaurant

Every

order paid before it cooks, across table, website and phone. Zero unpaid tickets on app orders in 60 days.

6 in 10

app orders last week paid with Apple Pay or Google Pay, which takes seconds.

67 of 95

card declines in 30 days came from the restaurant's own fraud rules or payment page, not the guest's bank. We traced each one and fixed them.

Our proof restaurant in Houston, from its own order and call records, October 2026.

The decline number matters. Pay-first moves the payment moment earlier, so a bad payment page or an over-strict fraud rule turns away real guests. Watch declines by cause from day one.

If it already happened

What to do after a walkout

Call the police and file a report. In Texas, leaving a restaurant without paying can be theft of service under Penal Code section 31.04, and the law presumes intent when someone leaves without paying where payment is normally due right after the service. Give the officer the time, the table, the amount and any camera footage.

Do not take it out of the server's tips. Under the federal Fair Labor Standards Act, tips belong to the employee and the employer may not keep any part of them. Wage deductions that drop a tipped worker below minimum wage are also off limits. State rules add more limits, so check yours before any deduction at all. Then fix the process so it cannot happen again.

Questions owners ask

What is the best way to prevent dine-and-dash?

Have guests pay before the kitchen cooks, through QR order and pay at the table or at the counter. Other methods only deter or help you chase it later.

Is dine-and-dash a crime in Texas?

It can be theft of service under Texas Penal Code section 31.04. Leaving without paying where payment is normally due right away is treated as evidence of intent. File a police report with times and footage.

Can I make my server pay for a walkout?

Not from their tips: federal law says tips belong to the employee. Deductions that push pay below minimum wage are also not allowed, and some states ban them outright. Check your state labor rules.

Does pay-first ordering annoy guests?

Casual-dining guests adapt fast, especially with Apple Pay or Google Pay. Explain it at the door and let staff help anyone who struggles.

Does pay-first stop unpaid phone orders too?

Yes, if the phone order gets a pay link and the ticket waits for it. That is how our AI phone host works.
